The association criticizes the interpretative circular published Wednesday by the Brussels government concerning this court decision. According to “We Are Nature”, the regional executive is forcing administrations to continue analyzing permit applications, without specifying how the Region intends to respect the judgment obtained by the association on October 29 before the French-speaking court of first instance in Brussels. For the association, this circular aims to circumvent the legal decision.
It also considers that by continuing to issue urban planning authorizations on the land concerned, the Region takes the risk of increasing the cost of possible compensation claimed by owners if the permits cannot ultimately be executed. We Are Nature announced that this circular will be attached to the penalty application file. The movement also indicated that Brussels deputies will be asked to obtain the withdrawal of the text.
The government on appeal
The Brussels government adopted an interpretative circular last week to allow administrations to continue examining cases during the appeal procedure. Two weeks earlier, the regional executive had decided to lodge an appeal against the judgment of October 29, 2025, which imposes to the Region to suspend the urbanization and waterproofing of undeveloped land of more than 0.5 hectares until the adoption of the new PRAS, and at the latest until December 31, 2026.
