Man nabbed whilst pinchin tucker gone and sues corner store, bloke on patrol

An Oregon man is suing a Portland grocery store and its security guard after a shoplifting incident two years ago. Joshua Charles Merkel, 45, filed a civil lawsuit seeking $10,000 for medical expenses and mental anguish. The lawsuit accuses Albertsons of negligence in selecting and training its employees, including the security guard.

The legal action follows a criminal case where the security guard, Matthew “Deme” Cooper, 31, was acquitted of assault charges. Prosecutors alleged that Cooper attacked Merkel outside the store, resulting in injuries including a shattered jaw and a black eye.

Merkel was charged with theft but testified that he never intended to pay for the items he took from the store. The extent of physical contact between him and Cooper is unclear. However, Merkel received medical treatment for his injuries.

Attempts to reach Merkel and his attorney for comments were unsuccessful. Albertsons and Cooper have not provided any statements regarding the incident.
