The administrative court of appeal of Bordeaux (Gironde), by a judgment of January 2026 which has just been made public, confirmed definitive exclusion of a student from the nursing school of Châteauroux (Indre)! The latter was judged unable to provide care without risk for patients despite six years of training.Â
Authorisée à tripler sa troisième anée
The student had registered with the Nursing Training Institute (IFSI) at the Châteauroux-Le Blanc hospital center in September 2015. She had first “repeated her first year” then “suspended his training for a year“, before finally validating his second year and beginning “his third year of training” in September 2019.
Dès le 28 août 2020the management of the établissement the availability « alertée sur d’importants difficultés constatées » but the availability « autoresée à redoubler sa three yearsée ».
« Après un nouvel échec », elle avait même été autorisée à « tripler » sa troisième année and à perform des   complémes de stage  Â.
Recurring errors during your internship or training
On this occasion, she completed an internship “in the medical department of the Châteauroux-Le Blanc hospital center.” “Despite reminders (…) both in class and during internship,” she had committed “recurring errors in the administration of treatments to patients» and «performed a potentially dangerous act of care« .
Estimating that after six years of training she “still didn’t master” the “précautions standards to respect the rules of hygiene and asepsis”, the section responsible for the educational treatment of the individual situations of students voted unanimously, the May 20, 2022in favor of its definitive exclusion.
In addition to professional shortcomings, relational problems
The establishment also accused him of relational problems with professionals and patients – “one of them had complained of sudden gestures†– as well as non-compliance with “the instructions provided for in his apprenticeship contract†and le refus de « reconnaître ses erreurs »making its supervision “difficult”.
But the student considered this décision « disproportionnée » : she had seized the administrative court of Limoges to request her réintégration within fifteen days, subject to a penalty of €100 per day of delay.
But in mars 2024the court rejected her appeal, emphasizing her inability to “question her failing practices and to integrate into the teams, with which she had come into conflict due tocasual or aggressive behavior“. She then turned to the Bordeaux administrative court of appeal.
« Méconnaitre de manière récurrente les règles d’hygiène »
The fact remains that the latter “met persistent difficulties throughout his six years of trainingboth in terms of the acquisition and putting into practice of professional knowledge and skills, and in terms of attitude towards patients and healthcare staff,” confirms the administrative court of appeal of Bordeaux in a ruling of the January 29, 2026 which has just been made public.
This situation had also repeatedly led her to disregard the rules of hygiene and to make errors in carrying out care procedures, without her being able to take into account the comments and advice of her trainers in order to progress in her professional learning, despite the implementation of several contracts. educational support.
3185 hours of internship instead of 2100!
Thus, during his various internships, his tutors had noted “his shortcomings in respecting the rules of hygiene and in the execution of acts of care, his lack of team spirit, lack of organizationin desire to always have the last word« .Â
In 2021his internship in the intensive care unit of the Châteauroux hospital center even had to be interrupted for these reasons.
In avril 2022the director of the IFSI therefore pointed out “serious errors with regard to what can be expected of a student in the third year of training in IFSI:
Errors such as the lack of verification of the care plan leading to administering treatment from one patient to another or the introduction of the cannula of an enema device to a patient without having removed the cap.
“Despite his six years of training within the IFSI and his 3,185 hours of internshipinstead of the 2,100 hours usually planned, the theoretical, technical and behavioral shortcomings of [l'étudiante, ndlr] have endured and are likely to create a proven risk to patient safety taken care of,” therefore estimated the administrative court of appeal of Bordeaux.
Her definitive exclusion has therefore been confirmed and she will now have to pay 1.500 € to the IFSI to cover its legal costs.
